Terms and Conditions for Haus Vacation Rentals, LLC

1. Introduction

These Terms and Conditions ("Terms") govern your use of the website operated by Haus Vacation Rentals, LLC ("Haus," "we," "us," or "our"). By accessing or using the website, you agree to be bound by these Terms. If you do not agree to all of the Terms, you are not authorized to use the website.

2. Use of the Website

You may use the website only for lawful purposes and in accordance with these Terms. You agree not to use the website:

In any way that violates any applicable law or regulation.

To harm or exploit any child.

To transmit, or procure the transmission of, any material that is harassing, offensive, defamatory, obscene, or otherwise objectionable.

To interfere with the normal operation of the website or any computer systems or networks connected to the website.

To impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.

3. Booking Vacation Rentals

Eligibility: You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the website and book vacation rentals.

Booking Process: The website may allow you to browse and book vacation rentals offered by Haus or third-party property owners. The specific terms and conditions for each rental property may vary. You are responsible for reviewing all information and terms before booking a rental.

Payment: You agree to pay all charges associated with your booking, including the rental rate, cleaning fees, taxes, and any other applicable fees. Payment methods will be as outlined on the website.

Guest Occupancy: You agree to comply with the maximum occupancy limits set forth for each rental property.

House Rules: You agree to comply with all house rules established by Haus or the property owner for the rental property. These rules may include restrictions on noise, pets, smoking, and other activities.

Security Deposit: A security deposit may be required for some rentals. The amount and terms of the security deposit will be outlined in the booking confirmation.

4. Availability and Pricing

Haus reserves the right to change the availability and pricing of vacation rentals at any time without notice.

5. Cancellation Policy

For bookings of 1-27 nights:

100% refund if cancelled 60 days or more prior to check-in date

50% refund if cancelled 30-59 days prior to check-in date

No refund if cancelled less than 30 days prior to check-in date

For bookings of 28 nights or more:

100% refund if cancelled 60 days or more prior to check-in date

50% refund if cancelled 30-59 days prior to check-in date, less the nightly rate for the first 30 nights

No refund if cancelled less than 30 days prior to check-in date

For all cancellations, there is a non-refundable credit card processing and administrative fee.

Early Departure:

If you depart earlier than your scheduled check-out date, you will be charged for the full duration of your original reservation up to 30 nights from the date of early departure notification.

To receive a refund, you must cancel your reservation directly through the cancellation link provided in your reservation confirmation email. Refunds will be issued back to the original form of payment.

Please note that reservations made through third-party channels may be subject to the cancellation policies of those platforms.

At Check-In

If a property is found inaccessible, unclean or unsafe upon arrival, Haus Vacation Rentals will assist in finding comparable alternative accommodations or issue a full refund. Refusal of provided comparable alternatives will forfeit the refund eligibility.

During Your Stay

For power or WiFi issues, we aim to resolve within 24 hours. No refund is applicable if resolved within this timeframe. If unresolved after 24 hours, we'll help secure immediate alternative accommodations. Refusal of provided comparable options forfeits refund eligibility.

Hot tub or pool issues do not qualify for refunds.

Cleaning and credit card processing fees are non-refundable.

6. Disclaimer

The website and the information and services offered on the website are provided "as is" and without warranties of any kind, express or implied. Haus disclaims all warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, title, non-infringement, and security. Haus does not warrant that the website will be uninterrupted or error-free, that defects will be corrected, or that the website or the server that makes it available is free of viruses or other harmful components.

7. Limitation of Liability

Haus shall not be liable for any damages arising out of or related to your use of the website, including, but not limited to, direct, indirect, incidental, consequential, punitive, or special damages.

8. Indemnification

You agree to indemnify and hold harmless Haus, its officers, directors, employees, agents, and affiliates from any and all claims, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your violation of these Terms.

9. Intellectual Property

The website and its content, including but not limited to text, graphics, logos, images, and software, are the property of Haus or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, or commercially exploit the content without the express written permission of Haus.

10. Links to Third-Party Websites

The website may contain links to third-party websites. Haus is not responsible for the content or practices of any third-party websites.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws provisions.

12. Dispute Resolution

Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be held in Ulster County, NY.

13. Entire Agreement

These Terms constitute the entire agreement between you and Haus with respect to the use of the website.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect
